名誉毀損訴訟において、出版社を訴えず個人だけを訴えるのは、ほとんど前例が無い異常な行為である。
東京地裁・綿引穣判決は、オリコンのこの異常な行為を容認した。「全ての不法行為責任者に対して訴訟を提起する義務」は無い、としたのである。
しかし、この論は間違っている。次のような喩えを考えてもらいたい。
殺人事件が起こった。
実行犯と実行犯に拳銃を渡した者の二人が逮捕された。
しかし、なぜか、実行犯は訴えられない。拳銃を渡した者だけが訴えられる。
「全ての不法行為責任者に対して訴訟を提起する義務」は無いからである。
実行犯を訴えない訴訟はどう考えても不合理である。
コメント（拳銃）だけでは名誉毀損は成立しない。出版（拳銃を発射する行為）があって初めて名誉毀損は成立するのである。（注１）
それでは、綿引穣裁判長は、コメントした個人と出版社との関係をどのように考えているのか。綿引裁判長は、判決で次のような趣旨を述べている。（注２）
雑誌の取材に答えた内容が雑誌に載っても、原則としてコメントした人には責任は無い。雑誌は、いろいろ取材して情報を取捨選択して記事を作るからである。
しかし、そのままの形で雑誌に載ることが分かっていてコメントした場合は別である。その場合は、例外的に名誉毀損の責任がある。
この論は一見もっともに思える。
しかし、やはり間違っている。虚偽の論法なのである。
上の比喩にこの論を当てはめてみよう。
一般に、拳銃を人に渡したとしても、殺人に使われることまでは予測できない。この場合は、渡した者は殺人の責任は負わなくてよい。
しかし、殺人に使われると知りながら拳銃を渡した場合は別である。その場合は殺人の責任を負う。殺人罪で起訴されてもしかたない。
ちょっと待った！
それは、殺人の幇助でしょ？
なぜ、殺人罪で起訴していいの？
綿引穣裁判長は、殺人と殺人幇助の区別がつかないらしい。
恐ろしいことである。
名誉毀損の場合も、これと同様である。仮に、そのような形でコメントしたとしても、それは名誉毀損の幇助に過ぎない。
名誉毀損に関係があるからといって、コメントした個人だけを取り出して名誉毀損で訴えてよいことにはならない。
やはり、最初の比喩が生きている。
拳銃を渡した者だけを殺人罪で訴えるのは不当である。
同様に、コメントした個人だけを名誉毀損で訴えるのは不当なのである。
